These Terms of Service ("Terms") govern your access to and use of the HealthBook ME website at healthbookme.com and the HealthBook ME mobile applications (together, the "Services"), operated by HealthBook, LLC ("HealthBook," "HealthBook ME," "we," "us," or "our"). By creating an account or using the Services, you agree to these Terms and to our Privacy Policy.
Not an emergency service
HealthBook ME is not an emergency response service and is not a substitute for 911, 988, or professional medical, mental-health, or crisis care. If you are experiencing a medical or safety emergency, call 911, or call or text 988 (the Suicide & Crisis Lifeline), immediately.
The crisis-alert (SOS) feature notifies the personal contacts you have chosen; it does not dispatch emergency responders and does not guarantee that any contact will see, receive, or act on a notification. Message delivery depends on third parties (such as wireless carriers and our messaging provider) and may be delayed or fail. Emergency services (911/988) are always reached directly through your device and are never routed through HealthBook.
Eligibility and accounts
You must be at least 18 years old, or the age of majority in your jurisdiction, to use the Services. You are responsible for the accuracy of the information you provide, for maintaining the confidentiality of your account credentials, and for all activity under your account.
The Services
Depending on your use, the Services may include: crisis alerts (SOS), Trusted Contacts, appointment reminders, referrals, Peer Support connections, optional location sharing during a user-initiated crisis alert, and SMS notifications delivered through our messaging provider, Twilio. Features may change, be added, or be removed as the platform evolves.
Your responsibilities
You agree to:
- Use the Services lawfully and only for their intended purpose;
- Provide accurate information, including for the Trusted Contacts you add;
- Obtain any needed permission from people before adding them as a Trusted Contact;
- Not misuse the crisis features, submit false alerts, or harass others;
- Not attempt to disrupt, reverse-engineer, or gain unauthorized access to the Services.
Trusted Contacts and notifications
You choose who is in your circle of Trusted Contacts and can add or remove them at any time. By adding someone, you confirm you have a reasonable basis to contact them and to share that you have asked for help. Notifications, including during a crisis alert, may include your name and — only if you have enabled it — your location.
SMS messaging
By providing your mobile number and enabling notifications, you consent to receive text messages from HealthBook ME (via Twilio) related to the Services. Message and data rates may apply; message frequency varies. Reply STOP to opt out or HELP for help. See our SMS Terms & Consent for details.
No medical advice
Content available through the Services is for general informational and coordination purposes and is not medical advice. Always seek the advice of a qualified professional for any medical or mental-health condition.
Third-party services
The Services rely on third parties, including Twilio (SMS) and independent providers and organizations in our network. We are not responsible for the acts, omissions, content, or services of third parties, including whether a Trusted Contact or provider responds.
Intellectual property
The Services, including their content, design, and trademarks, are owned by HealthBook or its licensors and are protected by law. We grant you a limited, non-exclusive, non-transferable license to use the Services for their intended purpose. You retain rights to the content you submit and grant us the rights needed to operate the Services.
Disclaimers
The Services are provided "as is" and "as available," without warranties of any kind, express or implied, including fitness for a particular purpose and uninterrupted or error-free operation or delivery of notifications.
Limitation of liability
To the fullest extent permitted by law, HealthBook and its affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any failure or delay in delivering notifications, arising from or related to your use of the Services.
Termination
You may stop using the Services at any time and may delete your account at healthbookme.com/delete-account-data. We may suspend or terminate access if you violate these Terms or to protect the Services or other users.
Changes to these Terms
We may update these Terms from time to time. When we do, we will revise the "Last updated" date above and, where appropriate, provide additional notice. Your continued use of the Services after changes take effect means you accept the updated Terms.
